ELIGIBILITY

INTELLECTUAL PROPERTY RIGHTS

The Platform, Content, and Services — including design, graphics, layout, compilation, software, and other materials — are protected by copyright, trademark, and other intellectual property laws. Reproduction, redistribution, resale, automated scraping, or extraction of content without written permission is strictly prohibited. You acquire no ownership rights in any content or materials. The name Bitech Chain, logos, graphics, icons, and service names are protected trademarks. Unauthorized use is strictly prohibited.

PROPRIETARY INFORMATION

Proprietary Information refers to confidential information identified as such and excludes publicly available information, independently developed knowledge, or information lawfully received from third parties. The obligation to protect Proprietary Information continues for one (1) year following termination.

HYPERLINKING, CO-BRANDING, FRAMING PROHIBITED

Hyperlinking to the Platform, framing its content, or referencing its URL without prior written permission is strictly prohibited. You agree to cooperate in removing any such unauthorized content and accept liability for associated damages.

MODIFICATION OR REMOVAL

We reserve the right to modify or remove any document, information, or content on the Platform at any time without notice.

DISCLAIMER

THE PLATFORM, SERVICES, CONTENT, AND ANY THIRD-PARTY PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR MEET YOUR REQUIREMENTS. THE PLATFORM MAY CONTAIN BUGS OR ERRORS, AND WE ARE NOT RESPONSIBLE FOR INTERNET CONNECTIVITY ISSUES.

LIMITATION OF LIABILITY

WE SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL. IF APPLICABLE LAW DOES NOT PERMIT SUCH LIMITATION, OUR MAXIMUM LIABILITY SHALL NOT EXCEED FIVE HUNDRED U.S. DOLLARS ($500.00).

INDEMNIFICATION

You agree to indemnify and hold harmless Bitech Chain, its affiliates, officers, employees, and partners from any claims, damages, costs, or expenses arising from your use of the Platform, your breach of this Agreement, or violation of third-party rights.

THIRD-PARTY PLATFORMS

The Platform may link to third-party websites or resources. We are not responsible for their availability, content, policies, products, or services.

DATA PROTECTION POLICY / USER INFORMATION

Your use of the Platform and any submitted information is subject to our Data Protection Policy. We may use personal information in accordance with applicable data protection laws.

LEGAL WARNING

Any attempt to damage, interfere with, or disrupt the Platform is a violation of criminal and civil law. We will pursue all available remedies against offenders.

GOVERNING LAW AND JURISDICTION

This Agreement shall be governed by the laws of the United Kingdom. Disputes shall first be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to confidential arbitration in London under ICC rules before a single arbitrator, whose decision shall be final and binding.

DATA PROTECTION ADDENDUM

This Data Protection Addendum forms part of this User Agreement. Except as amended herein, the Agreement remains in full force.

1. Definitions
   1. Applicable Laws: EU or Member State laws governing Personal Data.
   2. Controller: The entity determining the purposes and means of processing.
   3. Data Protection Laws: GDPR and other applicable data protection laws.
   4. EU Data Protection Laws: Directive 95/46/EC, GDPR, and related legislation.
   5. GDPR: Regulation (EU) 2016/679.
2. Collection and Processing of Personal Data
   1. We shall comply with applicable Data Protection Laws in processing Personal Data.
      1. We represent and warrant that necessary permissions and consents have been obtained from data subjects.
      2. We maintain mechanisms for obtaining and withdrawing consent in accordance with applicable law.
      3. We do not provide Services to individuals under eighteen (18).
3. Security
   1. We shall implement appropriate technical and organisational measures to ensure a level of security appropriate to the risk in accordance with Article 32(1) of the GDPR.
4. Sub-processing
   1. You authorise us to appoint Sub-processors. We shall ensure that written agreements are in place with all Sub-processors providing the same level of protection for Personal Data as set out in this Addendum and required under the GDPR.
5. Data Subject Rights
   1. We shall assist in responding to requests from Data Subjects under applicable Data Protection Laws, taking into account the nature of the processing.
6. Personal Data Breach
   1. We shall notify affected Data Subjects without undue delay upon becoming aware of a Personal Data Breach and shall assist with investigation, mitigation, and remediation efforts.
7. General Terms
   1. Disputes or claims arising under this Agreement shall be subject to the jurisdiction specified herein. If any provision is held invalid, the remaining provisions shall remain in full force.
8. Amendments
   1. Amendments to this Agreement may be made from time to time at our sole discretion.
